hello, just got back from casino, got to the toll (customs) booth, i think they were going to just let us go through, then he asked if i was ever refused entry, i told him about the permit i had to get in 93. so we went to imigration, an they checked us out. while their i ask about entering while under a load. he said to get the paper work for a fast card. then when we were released he said that he ran a check on us to see if we could get a fast card, he said we would have no problems, an off we went, Outlaw

Maybe someone here can answer this for me. A member of my family has a record from 11 years ago. She is in the process of getting a pardon. She hasn't been stopped in over a dozen times she has crossed since then, including once on Sept 14, 2001 when security was probably at the highest it had ever been.

Does the record automatically show up when they scan the passport at the booth, or does the agent have to do another check to see the record? I understand that once they know of the record, it doesn't go away, even after a pardon, which then requires a waiver. But I've also heard if the US doesn't search the CPIC computer before the pardon, they won't know about it after the pardon is granted. She's concerned because her work will require the odd trip to Michigan, and is worried that the start of the pardon process may have raised a flag on her file.

I was tempted to go to the border myself, present my passport and ask the guy how he knows if I have a record or not, but didn't want to get anything attached to my file saying "s*&^ disturber, search vehicle thoroughly" every time I cross LOL.

I have a pardon..Your record does NOT show up. They only know what you tell them.
A pardon gives you the right to say no to that dreaded question. Ever been convicted?

Never tell them you have a pardon or its waiver time.
Again..it does not show up!

But according to the various pardon services sites, if they (the US) find your record before the pardon, they don't quash the record after the pardon.

I guess the question here is what does the guy at the booth have to do to find out a person has a record? I'm assuming that merely scanning the passport doesn't pull it up, or something would more than likely have been said in the dozen or so times she has crossed since the conviction. I can see the odd agent letting it slide, depending on the reason for the visit, but not every one she has encountered

Hi Outlaw, I read your message and have an answer for you about your DUI. Our laws in Canada state that if all you have is only one DUI, and its over 10 yrs ago, you do not require a permit to enter into Canada. You are admissible providing you have no other felonies or misdemeanors.

IF you have any other concerns, please post your question or call my office direct at 204-488-6350
