As expected, the Justice has informed Congress that the U.S. attorney will not prosecute Attorney General Eric Holder for contempt, despite Thursday's House vote."The longstanding position of the Department of Justice has been and remains that we will not prosecute an executive branch official under the contempt of Congress statute for withholding subpoenaed documents pursuant to a presidential assertion of executive privilege," says Deputy Attorney General James Cole in a letter to the House speaker, John Boehner.

The letter notes that during the Reagan administration, DOJ took the position that the contempt statute could not constitutionally be applied to an official who asserts the president's claim of executive privilege. That policy was first articulated in a memo written by Ted Olson when he was at DOJ in 1984.

Cole writes that the position has been asserted several times since then, most recently during the Bush administration in 2008.

He concludes by saying that the Justice Department has determined that Holder's response to the House committee subpoena "does not constitute a crime" and the Department will not refer the matter to a grand jury "or take any other action to prosecute the attorney general."

Now, when you say "this guy" should resign immediately, are you talking about Holder, or the guy who gives him his orders?

Obama is refusing to make documents available that almost certainly show Obama in an unfavorable light. And he's going after the Fast and Furious whistleblowers with vengeance.

Obama is refusing to make documents available that almost certainly show Obama in an unfavorable light. And he's going after the Fast and Furious whistleblowers with vengeance.

He can, and likely will, resort to murder if needed. Obama is an evil man and will stop at nothing to cement his power. He needs to be stopped. He likely ordered this operation and should be held responsible. IF, by chance, he did NOT know about it he should be fired for gross incompetence. It IS his job to know.

Two of them are now under the supervision of someone who has said "We need to take them down" and the " ATF needs to **** these guys".

Which is why he invoked Executive Privilege and doesn't want to make these documents available to Congress, since they probably show that not only did Obama and Holder know about Fast and Furious long before they claimed to have known about it, but that one or both of them were in on it from the very beginning. That's a row of dominoes Obama doesn't want to touch.

He already has. Read the link at the word "this" that I posted above. Everything he does is perfectly legal, as he's above the law as far as he is concerned.

Very interesting read. I am surprised that was on CBS. Obama is going to make them sit in the back row at press conferences with Fox News for that.;)

I know. Surprised me, too. CBS is very picky about what goes on their opinion pages. One of the criteria is that the opinions must be based in fact and not be just a lot of blowhard rhetoric. The pieces are often controversial, but this one was an in-your-face, wake-up-America! moment. The piece puts not just leaks into another light, but the way Obama thinks and does business, and how Inside-the-Beltway has had to change in order to deal with it. It's really scary stuff, not politics as usual at all.

From Fast and Furious to the DHS refusing to answer calls from Arizona regarding immigration status to targeted killings (including US citizens) by drones to the way he conducts the business of State, all indicate a de facto a coup d'état by an elected dictator. A coup d'état is considered successful when the usurpers establish their dominance, and Obama has done just that. It's a page right out of Coup d'État: A Practical Handbook.

When I said this sort of thing would happen prior to Obama getting elected I was ridiculed. I LOVE saying I TOLD YOU SO!

Obama is a radical leftist who was bought and paid for to be in THAT office to do EXACTLY what he is doing, eliminating the Constitution and all the RIGHTS he can.

Obama is anti-gun, anti-Constitution and anti-American. He will stop at NOTHING to outlaw private gun ownership. He knows that he cannot totally take over with 150 million gun owners out there. He KNOW that MILLIONS can, and will, fight. He also know that he cannot depend on at least 40% of the military to back his play. Purges are coming in the military. It IS the way of the left.
