A Question For The Pros

I have a small courier/transportation company and I have some customers that have freight going all over the country. Currently, all of my drivers have their own vehicle and are paid 70% of the revenue. I have a driver that used to drive for me when I ran another company. He is a great guy and reliable. However, he's broke and doesn't have his own vehicle. I always rent a cargo van for him, loan him some cash and then when he gets paid, I have back out all of the expenses and it's a huge pain. I see a lot of talk about paying a driver 40/60 to drive my vehicle. Would that driver be considered an employee? If the answer is no, how do you set up the contract? Does the driver lease the van from me? Any advice would be greatly appreciated.

This situation sounds like a very bad situation for you and this driver. Lot's of other posts here that can help you if you read them.....IF.

I have never run a van but this sounds like a major problem in the making. Too many red flags for my liking.

I'll add this too...courier package services are different than expediter freight. With courier moves - it's most likely 100% you come back empty, with expedite there is a good chance to come back loaded.
